§ 1      Scope of the General Terms and Conditions, restriction of the group of buyers and the delivery area

 

1. These General Terms and Conditions apply to the sale of goods via our online shops. These only apply to consumers of legal age who have their place of residence in the Federal Republic of Germany (FRG) or in the listed EU countries, to entrepreneurs with their headquarters in the FRG or in the listed EU countries, as well as legal entities with their registered office in the FRG .
2. The our products are only sold and delivered to customers who have their place of residence or place of business or headquarters in the FRG or in the listed EU countries and who provide a delivery address in the FRG.
3. The countries of the EU include:
   • Belgium, Czech Republic, Denmark, France, Italy, Luxembourg, Hungary, Netherlands, Austria, Poland, Slovenia, Slovakia, Sweden (Group I)
   • Spain, Ireland, Latvia, Lithuania, Portugal (Group II)

§ 2      Prices / shipping costs / prepayment

1. All prices include the legally applicable statutory VAT plus shipping costs.
2. The purchase price plus shipping costs is payable before the goods are delivered. Discounts require a separate agreement.

§ 3      Warranty / Defects

If the buyer is an entrepreneur, merchant or a legal entitiy, the following applies:

1. The customer's claims for defects become statute-barred after twelve months. This does not apply in the following cases:

•     if the defect pertains to an in rem right of a third party on the basis of which the surrender of the purchased item can be demanded
•     if we fraudulently conceal the defect;
•     if we have provided a guarantee for the quality of the item / our performance or a durability guarantee and the defect is covered by this guarantee;
•     for any claims for damages by the customer that seek compensation for personal injury or harm to health. We are liable to the statutory extent for any death, personal injury or harm to health for which we are at fault.
•     for any claims for damages by the customer based on a grossly negligent breach of duty on our part or on an intentional or grossly negligent breach of duty by our legal representative or our vicarious agent;
•     for claims based on a culpable breach of our obligation to hand over the object of purchase free of material and legal defects and our obligation to procure title thereto;

2. The suppsupplementary performance will be carried out at our place of business. Title to replaced parts shall pass to us.

§ 4      Place of jurisdiction, miscellaneous

1. If the customer is a merchant, entrepreneur or a legal entity, the law of the Federal Republic of Germany applies.
2. If the customer is a merchant, the place of jurisdiction for all disputes arising from or in connection with the entered contract is our place of business.
3. Should a provision be or become void, this shall have no bearing on the validity of the remaining provisions.
